Lease Addendum
Changing the language of the lease to legally include your new no-smoking clause is easy. We have a sample no-smoking lease addendum developed by a lawyer that protects you from liability. However, a no-smoking lease addendum can be as simple as any other change you have made to your lease in the past.
If you manage a building that is subsidized by the government, you can make the change to your lease in the house rules. HUD's Minneapolis Field Office recommends that landlords carefully plan for the policy so as to avoid a breach of contract. A well-planned grandfathering period of 6 - 12 months typically serves as reasonable notice.
